The MTCR is not a treaty and does not impose any legally binding obligations on Partners. The only activity prohibited absolutely by the Guidelines, to which all 35 Partner countries voluntarily subscribe, is the export of production facilities for Category I MTCR Annex items.
Mockup of Air-to-Ship Missile-II displayed at Sacheon Air Show. Images courtesy of Defense Today (http://www.defensetoday.kr/news/articleView.html?idxno=8239). Compared to the earlier graphic, the fuselage seems much more rounded, and this new mockup looks almost as if it's a Korean clone of Japanese ASM-3. ASM-II will be purely Air-to-Surface missile, as Surface-to-Surface and Submarine-to-Surface supersonic strike will be carried out using the much bigger Supersonic AShM. The design of ASM-II will also be the basis of Korean BVRAAM under development.
It was also noted that the missile would be sufficiently light and compact so that it could be carried by FA-50. In that sense, it would be pretty similar in size with the baseline (non-ER) ASM-3.
